Hey guys, i'm new to ORE but not 4x4ing. I joined ORE because i heard this happened and wanted to check out the forum myself.
This is disgusting behaviour and i cant believe that kiwis are lowering themselves to extortion - is this what we have come to? What has happened to the kiwi way?
What Ross Bolus and company have done is take advantage of 2 guys in a difficult situation and thought they could get away with it - but they didn't count on them joining ORE and revealing what a** they encounted and asking for help. Which brings the question to mind - how many others have been extorted?

your right, what they did is unacceptable and i hope will be sorted out, the contract they have used looks like one that may print off a fair bit? how many other people have been issued that ??
the recoveries you dont hear so much about are the ones where guys get called out for a recovery and do so, get a few dollars for thier time and effort for being able to provide that type of service and everyones happy.
some times they dont get anything due to the persons being recovered promising a reward for their time/efforts then not paying up, these are times that make you think "why did i bother helping that muppet?"...
running a vehicle that is capable of doing a safe recovery in those situations isnt cheap and takes a lot of effort to build/buy and the guys running them would like to be showed some appreciation for the efforts and skill. having said that its a donation/reward/thankyou not a bloody contract charge holding vehicles to ransom arangment...thats just criminal.
it is a shame the guys in question didnt know this community was here, we are mostly a good bunch.... mostly

This is a statement from Bay of Plenty Four Wheel Drive Club following a special executive meeting held yesterday.
1. BOP4WD Club was not involved in the recovery.
2. The use of the BOP4WD Club name was not authorized by the Club.
3. There was a request and an agreement for the recovery of both vehicles between the owners and the recovery team. The verbally agreed price was $3000 and the only claim made for payment has been for $2750 as per a signed contract.
4. The vehicles were ill equipped for Thompson’s Track. The owners of the vehicles did not want to be involved in the recovery & voluntarily left the keys with the recovery team & asked to be contacted when the vehicles had been retrieved.
5. Alternative recovery methods were suggested & rejected by the owners. This recovery was performed at the insistence of the owners who allegedly are uninsured for 4WD activities.
6. At no time have the vehicles been held ransom pending payment of the agreed fee. They have been properly recovered, securely stored, cleaned, & radiators and brakes flushed, thus restoring them to a drivable condition.
7. The Prado has been picked up & the recovery team are waiting patiently for the land cruiser to be collected. The LC requires some repairs to make it fully driveable and the warrant of fitness is noted as having expired.
8. The owner of the LC has not been able to be contacted and he should make contact with the recovery team to arrange collection of his vehicle. If not collected the vehicle will be handed over to the local police as an abandoned vehicle.

The way I read that statement it seems to contradict point number 1? If the club wasnt involved there wouldnt be any need to make any other points in the statement?

I only believe half of what is written up there.
A question tho...If they agreed on $3k where did the figure of nearly $8k come from? (i do believe they tried and FAILED to get $8k from them)
Also i believe that the club its self was not involved but it was indirectly involved because the secretary of the club used its letterhead and name to invoice these 2 guys.
They have backtracked majorily but i do believe that they did hold these trucks to ransom and only dropped the price and allowed the trucks to be taken now because they have been caught...

So if as stated in point 4 the keys and vehicles were left how does point 5 work?
And also if the club wasnt involved or didnt authorise the recovery how does it have so much information on what happend?
And shouldnt the person who used the club name without authorisation be suspended or dismissed from the club pending legal charges to be layed?

that statement sounds a lot more like damage control to me and I think the bit about the action they are taking against the members(?) for misuse of the club name and bringing it into disrepute was missing? Is that going to be in a follow up statement?

did someone not say the secretary of the club was involved in the recovery.
i beleive and elected member of a club is allowed to use the club name .. thats why they are elected to represent the members .
i could well be wrong but with any written contract there i a element of good faith as well
good faith by the party to pay for said service and good faith by the contractor to provide a appropriately priced service ... that is why in NZ you have 3? months to redress any issues with any contract ..
next step .. legally to recover a a vehical in a manor pertaining to profit the personal involved must have completed a qual in such a manor to demonstrate competency in the contracted job
you would need this as a part of the good faith aspect of entering into a contract with anyone
issues i see here are

and finally
who the contract actually was with
the clubs standing may be that they did not authorize the use of there name ... but that doesn't limit liability buy the club if said person was a elected member

I am a member of a group of offroad enthusiasts who gather in the internet in a place called OffRoadExpress & I have their sticker on my truck, I guess if I had been there then ORE would also be in the shit?
NO I was NOT there & do NOT represent the BoP club in this matter at all

ORE is not a club, but a forum, any activities including recoveries are private. the bill shown suggests it is from a club

looks like it works really well and is easy to get in contact with...

The guys who did recovery for us had walked up to there on 6th and give us help, I'm still appriate for that!
