Toy - Zuk chassis tub, hilux 4.88 axles and transfer, Nissan CA18DE motor and auto trans, sc12 supercharger, 32 10'5 simex, twin motor 8274 custom freespool. Well the parts are all there in various corners of the shed

I'm one of those buggers that stews on a problem... sometimes I wake up at odd hrs because I have worked out an answer :twisted: Normally this is from some engineering problem.... but in this case after reading Meatc's comments (thank you) and an offer that was made last night (also thank you I might be ringing you back mate with an offer :wink: )
I've got to go see some legal advice and talk to the courts
If I'm right I might just have turned the scam on Mr Hapeta Matthews
will hopefully join the dots today....

Im going against the grain here...I think the police do a good job...sure they might be a tad slack in some areas...but there are plenty worse police forces in the world. I'm grateful I (mostly) live in a country that inst corrupt. try working in a 3rd world...calling the cops is a waste of time...they stand back and watch people burn on a post...constantly loose keys...open to bribery, the list goes on

I don't have any problem with the police... I do have an issue with constable beven, the lass who investigated the case and to a lesser extent the local cops
The issue is they couldn't or wouldn't tell me its a civil mater and nothing would be done about it.... I only found out by chance when I tried to list his vehicle as stolen
My personal view is the cops do a crap job.... :lol: not the cops the job, dealing with societies crap, people who know the system and work it to there advantage (case in point), people who think they are outside of the system... then after all that they go out in public and have to deal with the stigma there job creates
To be honest its a job I couldn't do, because of that I respect all cops :lol: even if I'm getting ticketed

Right here's how I've delt with this or dealing with it, A cop off this board messaged me and explained the situation to me... he didn't give me an answer, what he did was explain to me how Hapeta convinced the cops its a civil mater.... by stating that me and him had a verbal contract :twisted: it took me a while to realise that means that it is now public record, recorded public record :lol: I have sent the forms in requesting a copy of the case
once I have this I can make up an invoice to the amount of sale, I will text it to him (kinda hope he dosn't reply lol you'll see) after 90 days I can legally charge resumble costs involved in the collection of the debt :twisted: now since he gave a fake name etc I've got to hire a private investigator to find him, I then lodge the debt with the courts both these fee's go onto the cost, my company has a policy of charging 10% interest monthly from the 3 month mark (stated on the invoice :wink: )
Then I go see a debt collection service, they get to charge there 10% or preset fee ontop to collect

I still only get my $2500 but I can see this being a very expensive truck to Mr Matthews :lol:

Now it hinges on a couple of things first his address isn't in the case file ,I'm hopeing that under the privacy act the police don't give me that, second he dosn't pay me when I issue the invoice

I like it But you can go to court and win get the judgement for costs etc he can claim lack of money and pay you back at $5 a week make a couple of payments then stop

:wink: I'm talkng about lodging the debt with the courts not taking him to small claims.... it just makes it easier to collect (I kinda missed the reason why all I heard was its another fee I can add to the cost :lol: ) I don't have to lodge it with the courts as I'll have a contract and invoices

:roll: :lol: it gets more stupid was on car jam this morning and out of curiosity noticed the vehicle isn't listed as stolen... figured I'd ring the police and find out whats going on :lol: get this it says in the police report that I've been paid!!
No wonder I can't list the truck as stolen even tho I'm the registered owner
The wonderfull constable never bothered to ring and ask if I got paid, she must have taken the word of a convicted con man that he was going to pay me :roll:
This stuffs up a civil action so needs sorted
I have left messages for her to contact me before and nothing and yet again nothing
I'm going to call an old client of mine who works in the hastings branch and see what he says about her

There are plenty of good cops around (like the good bugger that helped you out on here) but you seem to be finding all the useless ones out there eh :lol: :oops:

If it got any worse or if the nice lady constable doesn't rectify her report etc
then maybe stir things up on the inside, i.e. police complaints authority.
Or would that be going too far?

ok hav been through this been through this before with a cefiro as long as the registration and ownership is still in your name you can just rock up and take it and there is nothing here can do legaly to stop you I just went and got m car and the police turned up at mine a few hours later trying to do me for theft after seeing who owned the car ect they left with out charge

No I don't want to go to the police complaints... if she wont answer or the out come of this evenings call to her work mate turns out bad, I'll try and talk to her boss
you might laugh at this but I still respect the police for the job they do... I have to admit that respect is alot lower for the local branch and one particular constable... but its still there

As for grabbing the truck I'd rather take this civil and make the bastard pay.... as he has had near on 5 months use of the vehicle, given that he is probably expecting me to yank it out from under him at any moment.... I think its safe to say he hasn't looked after it and its been thrashed hard

I am surprised that the cops left without asking further, Just because its YOUR name on the "ownership" papers, does NOT confer ownership. It says so on the document itself. Its merely a form that lists who has the current registration responsibility.

Therefor, Reece, who has money owed him by the "alleged" thief, OWNS the vehicle until the debt is paid, doesn't matter two dogs turds whose name is on the registration form.

Reece, you have proof in the form of emails acknowledging the debt, can you register that fact within the legal system somehow?

Turns out the piece of crap truck I was left.... the same one that only lasted a couple of nights out on the street
Yea well it turns out it wasn't stolen... it was impounded by the police :lol:

The latest update on whats gone on

At the request of another constable I let things rest while she did her best to legally get the car back, she was keeping an eye on it also

In the mean time I had got a copy of the file from the police so I could send it in to the courts dept and the local councils so I stop getting the tickets
All referances to names and address's are blacked out... I expected that :roll: pricacy act and all, what pissed me was the lack of information from the original cops notes less than 1/4 of a page to say hapeta has paid :roll: I've given up on that :lol: bloody hell you'd think the cops would be the last ones to trust, there is no referance to anything he has said.... so I have no civil case (assuming I could find him to serve him)

Now this is where it gets rough
Got rung by a nice lass from the courts yesterday to ask when I would be sending in the police file so they could transfer liability as the tickets are building up.... I asked her how many and was told she couldn't give that out as they didn't concern me, I then joked that its good to see Harpeta is going to have to pay... this is when she told me "no"
"The debt is transfered to the vehicle and the baliffs will confiscate it and sell it to pay for the fines.... he isn't even liable"
I asked if there was any way this could be avoided and she told me only if it was a criminal issue
Her last comment was "I learned a lesson".... I bit my tongue and just hung up

Oh and just a capper from past conversations with the cops I've been told they will tell the courts where the vehicle is so they can go pick it up

I'm too mad to do anything
Yesterday I was that mad if I could have found him I would have put him in hospital for a long time! I'm still seriously considering it... my back is stuffed to the point I'm looking at a yr or more out of work, a month or two in Mungaroa, doesn't seem like a bad deal... the cops are useless (well the local ones are from my experience...)

Toying with posting this up on every automotive forum in NZ and naming the Cops who investigated this (apart from the last one, from what I seen she tried...)
Is it worth going to police complaints
I'm also going to pass this on to Fairgo as they have busted him before
Anyone got any other suggestions
Oh and I'm going to ask a favor of some less legal people to help me find him... so if I decide to I know where he is... oh and before anyone suggests it no I won't get someone else to nail him thats not my style...

The legal system in NZ sucks - sometimes it feels like criminals are protected and the cops force nomal law abiding citizans into taking things into their own hands, at which point they too become criminals.. :evil:

I can almost see how this is going to end...That dork will get off scott free - minus a vehicle that wasn't his anyway.
He will rightfully get his ass kicked, you will go to jail and then be paying him compensation while he sits at home on the dole drinking double browns and lauging all the way to the bank!!

Beat the snot out of him on a rugby field. From what I can tell, anything is legal on the field except taking a slash.
