nzfwda don't have any authority to close tracks they are only negotiators with controlling bodies and messengers back to their member clubs

NZFWDA has no authority to close tracks on Department Of Conservation land, never has had and never will have. The reason is that all Department Of Conservation land is closed to all vehicles at all times, unless use of vehicles is specifically permitted. What NZFWDA is trying to do is gain the authority to open some tracks to some vehicles. In the case of the track referred to here, one of the big sticking points is silt getting into waterways, especially in winter. We have a plan in place to mitigate these problems, which will include a winter closure, but it is very hard to convince the Regional Council we can effectively put this plan into place when they see vehicles accessing the track in winter and thereby increasing the silt flow into the waterways.

I need to make it very clear to everyone that the Waitawheta Track at the end of Tairei Road in the Waikato is closed to all vehicles of any description and there is no excuse for anyone being in there in any sort of vehicle.
Just because the gates have been vandalised, doesn’t mean that the track is open. Just because the closed signs have been stolen doesn’t mean that the track is open. Just because you are a local, doesn’t mean that you can use the track. Just because the bollards on the road have been stolen doesn’t mean the track is open. Just because other people are using the track, doesn’t mean you can as well. Just because you can pretend that you didn’t know that the track is closed, doesn’t mean that you can use the track. Just because a lot of other arears are closed, doesn’t mean that you can use this track. Just because you think you won’t get caught or have used it before, doesn’t mean you can use the track. Any combination of the above doesn’t mean the track is open.
Waiawheta Track at the end of Tairei Road is closed to all vehicles. No exceptions
Currently there is an abatement notice issued by Waikato regional Council against DoC requiring then to keep all vehicles out of the area. That can be enforced in court and large penalties apply. Using the track is also in breach of the Conservation Act. I suggest that you have a look in the penalties section of that Act if you are thinking of going in to the area.
NZFWDA has put a massive amount of effort into getting this track open and the biggest stumbling block at the moment is proving that we can prevent over use of the track by closing it from time to time. Every time someone uses that track when it is closed, it gives the groups trying to close the track forever more ammunition to reinforce their argument and weakens our argument that we can control use of the track. That means that those who are using the track at the moment are making it even harder for everyone else.
Waiawheta Track at the end of Tairei Road is closed to all vehicles. No exceptions, no excuses.
Please do not use the track, and report any use of the track to Police and or DoC. And please share this post as widely as possible

It might help if the area name is correctly spelt... it is Waitawheta Track... not Waiawheta Track.

Closed tracks are to be respected, there generally is a good reason for closure.
