i gotta say, this is all just a bit of a shambles really.
my 2c is that a lot of people
jump to conclusions,
fly off the handle and
run riot in these instances!

thats too much exercise lol
it seems the guys that got stuck have been given a bum rush and that there is enuff bad publicity against 4x4 as it is without this blatent extortion and dodgy goings on!
is this thread been picked up on any other 4x4 forums????

just curious? are the people in the photos they people who did recovery or the people who own the vehicle. p.s this thread has been one heck of a read!!

Yes that what it means exactly.
Since the club president has stated that in his response. He is most defiantly committed this crime for which he should be charged. But I'm not sure who would have to lay the complaint, the person whom he used the form on, or the club who he stole the form from. Best to talk to your lawyer and get this clarified. as I would think that if this charge was laid at his feet he would shit himself. and probably end this matter very quickly

awesome i'm sure you will have a large group of new 4x4 buddies after this unfortunate episode
i'm in the waikato now heading down to wellington soon though so a bit hard to join up for a trip that and the fact my 4x4 is an ongoing project

The guys who did recovery for us had walked up to there on 6th and give us help,
I'm still appriate for that!

Ha it sure does look like rainforest challenge! hahaha, and the vehicle does look very set up for Thompsons, i was expecting it to be a road going prado on road tyres by the way Ross made it sound.
If you need a hand to fix anything more or need a place to store it you guys are welcome to store it at mine, I also work as a diesel mechanic so have access to a full workshop if needed.

I have read every post and there are some things that just do not gell from the club's end I'm afraid.
In any club there are officers who are given authority to act on behalf of the club for certain things, such as the treasurer can spend money and the secretary can author contracts. In this case the secretary has authored a contract that seems to have led to the extortion of money from a victim. Added to that it appears that the signing was under duress and the signor was under threat of harm if they did not pay within five days.
It is too late for the club to now say that these actions were not authorised because they were undertaken by a duly elected (assumption on my part) officer of the club was acting in accordance with their role as secretary. Additionally the secretary was acting as an agent for the club and the victims were not to know his actions were not sanctioned, therefore under the law any civil case is against the club for costs, but any charges of threats of potential violence will be against the individuals concerned.
The secretary has led the club into a situation where it is now alleged that the club sought to and succeeded in extorting money from its victim. It cannot back-track from that. Any other trustees/officers of the club may be equally liable.
Tony Burgess. As a member of the NZ4WD Association I do not believe that the association should be supporting this club in question given the seriousness of the allegations. The support given, from what I have read, gives tacit agreement to the club's presentation of facts, but (as others' have said) those facts are illogical and contradictory. The only cogent set of facts I have read so far have been from the young men who are the victims. They have been able to provide explanation, documentary evidence, and photographic support for their case. The club has not.

In a nutshell. Cogent concise and to the point.
As a member of this organisation, (NZFWDA) I am appalled at the actions of a fellow member, and officer of an affiliated club. Especially since THAT officer has compounded his actions (Extortion with threats and menaces) on a club letterhead!!
How fkn DUMB is that?

Im sorry but the people in the fore mentioned club at the start of this thread are just a bunch of tossers!!
Who the F#$k charges $8000 dollars to rescue 2 trucks, these guys need to have thier heads read,god help them if they need to be rescued one day!!!
What happend to helping fellow 4wd enthusiasts out? Im sure that many of the clubs in NZ and Aus would be discusted at thier actions!!

From my point of view:
If we sue the club as Defendant on the court,(yes,coz club name on the contract)
then the club will sue someone unless they don't care to be convicted.

the ird may investigate, as it being a very serious crime not paying taxes
there are a raft of issues the police could investigate many mentioned, have you informed the police?
the issues the club has to deal with moral and legal, of there members doing a bit a dirty are up to them what happens and i'd assume with the publicity gained and pressure from nzfwda that club members acting on behalf of the club will have a lashing to deal with if not expulsion for life.

Zero4, are the Police involved yet?
Don't muck around mate and go in and see them if you haven't already. While you are there, give them this link to read too. It shows a lot of public interest - all in your support.
They (Police) may not be 4WD'rs and this would also show them that that type of behaviour is not accepted in the 4WD community.
Anyway, let us know when or what you have done and then you may need to shy away as the coppers may not like you discussing it once they are investigating.

Tony needs not to be affected at all, hes a good bugger and if he was doing anything, it was simply to try and keep things from getting outa control, if he knew something before the rest of us, it wasnt his place to spill the beans pre-maturely, considereing his position..
theres plenty of others that deserve broken teeth without dragging outsiders into it
