ok zero4 whats the answers to the above questions
it concerns me on how quite you have become and also how the other party hasnt decided to give their side of the story
we have all done the tipicle kiwi thing as in jump straight into the deep side of the story.
BUT
you still havent revelled who you were dealing with nor who the club associantion is
come on and spit the details otherwise im thinking that this might be a little more then meets the eye
also you havent revelled why on earth you decided you would try thomos with one winch and a shiny second truck as support
zero4 we need some info as at current moment the team is backing you but as this is your 1st post and now your silence im smelling something a bit fishy is going on

BOP club might be good at teams recovery with competition buggies but when it comes to recovering full sized vehicles they are out of their depth.

Don't be too quick to judge. I am guess these guys are working to resolve the issue and I am sure there are now emails and phone calls going back and worth, especially as certain reputations are now at stake.
Don't condem them for going into Thompson with only one winch. They made a mistake through inexperience and lack of knowledge. Now a few low life members of a (previously) well respected club are holding them to ransom. That is totally wrong.
Legal action will no doubt be forthcoming so all sides will be cautious as to what and where they say anything.

Many moons ago I talked about this with a towee in Wanaka. The way the law sees it is pretty simple, if you tow someone out and get paid, then its a commercial transaction and you need to have a recovery licence. He did however say that if I pulled a mate out, broke something on his truck and he took me to small claims, my liabilibty would hinge on the arbitrator's opinion of the event. So basically towing someone out is "at your own risk".
When I've been called by people to help get people out I have never expected to be paid for broken gear etc, I just hope to get beer

If I break something then I haven't assesed the situation correctly.

yes you do have to be a registered to charge for salvage and tow.
which means you also need a recovery endorsement as well as a Trade service license and to be G.S.T registered.
so i wouldn't bother paying until they can prove these documents are in there legal possession.

Don't bite my head off, but I'm good at looking at things from different aspects
Here is a possible "other side of the coin" perspective:
Some muppet and his mate who we don't know from a bar of soap, tried to take their trucks through one of the North Islands most notorious tracks.
They were obviously ill prepared both in vehicles and experience to know when they were out of their depth. This is obvious due to their current predicament.
They called for the assistance of the locals, who sick of the muppets they have to rescue from the same spot time and time again, agreed to for a steep fee. Xmas holidays, being dragged away from family's and all that added to the cost.
They arrive to find two LWB mall crawlers on mud tyres with one electric winch between them stuck in the well known mother of all bogs that a tiny amount of research before the left would have warned them of.
The rescue crew have a crack, but the buggies (they were very lucky to find someone keen to go rescue them at that time of year) are no good, so they give up before they do serious damage to their vehicles.
They come back with more man power and the heaviest trucks they could find due to it being the Xmas break.
Its hard work, its hot, the mall crawler in the bog shouldn't have been there much less his mate with out a winch, both stuck vehicles have fark all recovery and jacking points making options limited, everyone is pissed off cause these muppets shouldn't have been there in the first place, they are being useless, standing around doing nothing to help.
As the day wears on, the general feeling amongst the crew doing the salvage is "these dick heads are paying for this, everbody is putting their time and gear on the line, just for the because of their stupidity and they just don't have a clue, they still don't get"
Once the vehicles are eventually recovered a strong clear message is sent to the owners that what they did was not acceptable, and in order to make the point strongly and teaching them a lesson, they attempted to hit them where it hurts and delivered them a bit of a scare by bumping the bill up with idiot tax

Yeah its every bit as possible as the other option and they are just having a bleat on a public forum. I thought that also but surely people aren't silly enough to stir up the masses with the comments previously posted without some reason

I Agree to a point Pete but why should anyone have to pay the amount asked for what was obviosly a poorly executed recovery using badly maintained gear ,there is no rxcuse to break the amount of gear they say they broke .sure we have all done things that in hinsight was stupid but to try and take advantage of the situation as these guys are seem way over the top .its just extortion .I think if they had stuck to the original quote had trucks that were suitable with people with the experence required we would not be having this discussion now and those recovered would of learned a valuable lesson without being kicked in the teeth...

Answer for the questions above,
Yes,they still hold my truck.
Update:
I have received a call 9:22pm yesterday,someone told me if I don't apologize here,they will put my truck back to where I got stuck or I may never see my truck again.
I would happy to pay the $$$ to who got my truck out unless you force me pay the $$$ to my lawyer.
Why I haven't name the guy and club only coz I think everything can be discuss,isn't it?
Anyway thanks all you guys help,I swaer all I told is the truth.

Put it back where it was stuck. Imagine what that might cost given how much shit they broke.
Ultimately I think you will be parting with cash BUT it should be the pre determined amount not the massive final price.
If everything you say is correct:
Tell em you will be notifying the cops regarding the matter if it can't be settled....
Don't name em on here....yet. Give em every chance to redeem themselves first and clear it up without it getting too messy.
You are not personally attacking anyone on here just discussing the incident and it almost seems discussing a service which you are having to pay for. I wouldn't apologise IF things are how they appear to be.
The one question you didn't answer??
Are you a kiwi/local or not. Again not trying to be offensive, just trying to understand things a bit better.

Yea get your vehicles back ASAP as you said they were sitting in water overnight - some maintenance will be needed.... now!!!

sounds like an unfortunate but educating experience,
now, jump off your computer and do something about the fact your wagons are being held ransom, and damage being threatened...
either
a) pay the chaps money being demanded in true extortionist style
b) negotiate a rate more suitable if you are prepared to
c) ring the cops and ask them to assist in "recovering" your recovered vehicles.
or any mix of the above, sitting on a computer contemplating life searching for enlightenment isnt going to get your wagons back in your driveways.............

i think when the word "lawyers" are mentioned then, if not in print then can't be used against you, there is a shitload more to this story that zero4 is not telling, he may be telling the truth but sure as hell not the whole lot

I have been watching this thread with much interest and knowing how this forum works and how many clubs have a resestance type membership of ore faithfulls I find it all a little hard to believe.
Specially as no one has piped up in defence of the so called pirates and said ty ho its being sorted please stop posting.
I may be wrong but every story has 2 sides and with only one being told its nothing more than that................... just a story!!

I reckon that sums the situation up well.
One problem, it should have been made aware to vehicle owners that the price had skyrocketed.
If it was me in this situation I would be in contact with the police IMMEDIATLY.
