Brought a car with cracked head,anyone know my rights?

Hey just after some info,father inlaw brought my fiancé a car(5 weeks ago) its a 95 dihatsu charade and from day one it was using oil not leaking it,using shit loads,and it was clogging up the radiator.it was brought from backpackers cars in chch and he was told it was owned by an old lady etc etc, it may have been but that was before the mechanics that are tied up with the car yard used it for a few months as a run around.he was told it had been well serviced and this seems like bullshit and also the head had been off,one would suspect that they new something was up with it but put it back together anyways and on sold it.the motor seems to be toast.the guy who sold the car seems to be side stepping everything.what are his rights here? Can he get his money back?Rich

If he's a LMVD then I'm pretty sure you have 28 days to make him fix any problems. I had a similar issue with the gearbox in a turbo Subi I had years ago. After much whinging about how it wasn't their problem, I mentioned the Consumers Act.......... Issue sorted quick smart :wink:

So perhaps a call to the MTA is in order?

Thanks for the info so far guys.theres been a few lies told on his behalf so hopefully sort this out next week.o and smurf your tie down is coming back hopefully drop it off this week 8)

Did you buy it by auction or straight sale? What does it say on the CIN form you signed in the price box?

if all that shit fails you can always get a lot of satisfaction from a simple brick through his window or give the disputes tribunual a crack and see what they come up with they are usually swayed on whats fair. I always try and do all dispute communications in writing by email so theres a documented transcript of whats been said and the lies and bullshit you get told coz anything verbal is hearsay and worth nothing when your trying to put it infront of another body like mta or disputes tribunual... nothing beats somebody tripping themselves up in writing :mrgreen:

I had previous experience with MTA & found them very unwilling to help or even reply to message left with them , that was until they were told we were going to the media ..then they responded real quick.

i have dealt with backpackers cars before and he seemed pretty fair when i had a problem.
maybe if you go in and tell him you will lodge a formal complaint then he might be more inclined to help you out

Providing the dealer has breached at least one of the acts (read them VERY throughly) you'll get it sorted at their expense.
IMHO the MTA route is a waste of time...seems they like the membership fees they receive. :roll:

haha like your style m8 but break fluid can do alot of damage too alot of paint jobs lol just remember if u get fuked over revenge is sweet and can last forever :lol: :lol: :lol:
