What do I do with this theif....

I'm at a cross roads.... I know what I want to do, but do I do it and get and possibly get in trouble

Here's the story
This involves a Nissan Mistral (BZM953) that I had sitting outside my workshop (de-reged, but a good runner)
Around the 31st of Jan, a guy rocks up off the street wanting to buy the truck... we came to an agreement of $2500 on condition it passed a VTNZ check, after showing me his drivers licence (Mathew Loggan) he leaves his vehicle and takes mine to the hastings VTNZ due to his work this takes a couple of days apparently it passes a warrent check but is pulled up for no reg he comes back to me to discuss it... while we are discussing it at my workshop he offers me a business opertunity that he has seen dealing to the waste steel from a local company he works for (after a fair bit of research this turns out to be boggus possibly a scam)
He books the truck in for a re-vin at the hastings VTNZ they can't take it for a couple of weeks... he wants to keep the vehicle so he can fix up some small problems I agree...
He swops the vehicle he left me... so he could give the one that he left me to his daugther... all good I've still got something that is better than my truck
Due to work conflicts with his shifts he was unable to get the truck in when booked so it dragged out, then a tungi in Te Aumutu.... then the contact stopped no replys on the phone or email

Had a look at the truck I'd been left its scrap weight blown head/gasket and a heap of warrent issues

Do a search Mathew Logan turns out to be an alias of a con artist Hapeta Matthews
So I go to the police list my truck as stolen
Interestingly they find him, takes them a over a month to go and find my truck is still there, they talk to him he promises to pay I got a text from him even to say he'd left some money in my mailbox lol na
it has been near a 3 weeks and nothing, I've just had to get in touch with the police to get a letter saying I didn't have the vehicle because the courts are fining me for the use of the vehicle!!

I went to the police in the first place so I wouldn't do something stupid like hurt this guy... lol I don't care about him, i just don't want an assult charge

The way I see it the police arn't interested so its time for me to act
I have mates watching a number of properties looking out for the truck
I even have a car load of mates keen to come along for a drive

Do I bother trying to force the police to do something....
Or do I hunt the piece of trash down and get it back plus something to cover the use of the truck....

what exactly would you been doing wrong?
you are simply picking up what is rightfully yours, which was stolen, there was an issue and the guy got violent, then a broken nose... he has a criminal record, you dont.... im assuming.

Whatever you do, make sure it happens outside of his house on the footpath, he has more rights than you if you are tresspassing, of beter yet, just follow him and do it away from his house...

fckin hate this shit, its simple and this guy isnt exactly going to dob you in is he??
this is why these guys do what they do cause they get away with it cause they know they can

You go see a tow company with ownership paper in hand and ask for the biggest burliest driver they got and ask them to go pick it up.( okay may cost a hundy or so )but towies have more then enough experience dealing with people like this. They will also arrange for he police to be present during the recovery too.

if not pm me, i used to repo cars for a while for extra money.

What about insurance and will taking it back into your possession now cause a hiccup with the fines related to it?

possession does not mean ownership he would get the fines anyway.
add to that the police know about it so any fines after that are on the person in possession.

file a dispute with the courts, F57. take you evidence with you as well as the police complaint number. It happens to car dealers all the time.

Mate, take Crash's advice. This keeps you on the right side of the law.
or, trailer the POS he "swapped" with you, a bunch of mates to help you push his off and yours onto the trailer. You cant push a truck by yourself, now, can you?

I see he ran a scam in Christchurch too around the demo game. just another piece of shit that seems to just keep on getting away with ripping people off.

I found this so he is very well known to police so shouldn't be to hard to get them on your side to help.

A man who allegedly stripped a couple’s bathroom, charged them $6600 and then disappeared has been arrested.

In September, Flaxmere residents Joyce and Barry Brough were left with no bathroom after the man claimed he’d received building consents to refurbish their bathroom from Hastings District Council, stripped the bathroom down to the framework, charged them and left.

Going by the alias of Matthew Logan, the builder offered the couple references, proof of liability insurance and had a sound knowledge of building terminology and council process.

He later provided the Boughs with letters from Hastings District Council that led them to believe they had a building consent for the work.

It turned out the man had drawn up the letter himself.

Hapeta Mathews, aged 54 of Flaxmere and is believed to have used the alias Matthew Logan before, was arrested this week in Hastings and he will be appearing at Hastings District Court on Friday, September 10 on various charges.

Hastings Mayor Lawrence Yule says he’s glad hear that someone who has taken advantage of Hastings residents in this way is having to face the consequences of his actions.

Mrs Brough says she’s glad Mathews has been arrested.

“I’m still coming down from the ceiling, I’m so happy he’s been caught. I don’t know how many other people he’s done this to but I hope this stops him doing it again for awhile.”

The day Hastings District Council building officers were made aware of the couple’s dilemma they were on the phone to contacts in the local building industry.

Companies were more than keen to help them and now the Broughs have a state-of-the-art bathroom.

Mrs Brough says she’s delighted with her new bathroom and, considering the dreadful start to their renovations, it has all worked out better than planned.

The Broughs would like to thank Seth Palmer Builders, Tumu ITM, Plumbing World, Pete the Plumber, The TileShed, tiler Anton Mau, Atlas Fibrous, Maurice Gray Painters, Dulux New Zealand, Smith&Smith Glass, Carters Hastings and Copas Plumbing & Electrical, Georgina Wahi at Neighbourhood Law Office and HDC building officer Mike Skelton.

Yep the tosser is living in Hastings... the police havn't given me his address or real name lol but as you can see from centralnavaras post google is good enough, I've narrowed him down to one of three address's and got mates looking out for the truck.... just a waiting game at the moment
Yes I was down windy ways but garith is a bit of a slave driver lol he worked us too late to be sociable
back up home now, time to sort this lol
I've got in touch with the hastings police and will be getting a letter to give the courts so I stop getting fines and can get the one I've recieved canceled

you watch what ya do, a jerkoff slashed my sons tyres the other night all four of them.My son and his mates all said the same name of the jerk that did it, so i go round to his dads place .dad doesnt care. so go round to his sons place and give him a tickel up :lol: .then the jerk goes to mummy and the fat cow rings the police and i get an assult charge,which i got off lucky lucky.as i would of lost my gun liceince and had to got to court etc.so play it cool and FARK HIM UP :D

Land lord gave me the word to move the scrap truck Hapeta had left me so I put it out on the street, flat tyres, locked up and disabled :lol: it lasted 2 nights before it disappeared
Rang my dodgy mates non of them were willing to own up :roll: rang the council they hadn't tow'd it... so being the good person I am I rang the police (yea ya got me :lol: I don't care about him or his truck I just dont' want this to come back and bite me)
Call goes something like this
Rang Constable Bevon (she is the one investigating this ) ended up with another cop
"Hi this is Reece Barber, I'd like to report a vehicle stolen..."
"Where from and reg.."
Gave her my shop address ".... can't remember the rego, it wasn't mine..."
"I'm sorry only the owner of the vehicle can list it as stolen..."
so I explained the issue to the police man, told him the case number
He then drops a nice little bomb shell
The case has been dismissed "a civil matter, not enough evidence to convict, both parties have a resolution...." what the Aghhhhh! :roll: I told him I'm now hunting for Hapeta, told him to list the truck as stolen
After being transfered to the stolen goods line got told, you guys are going to laugh at this
"Oh this is a civil mater you will need to go see a constable at your nearest police station so they can decide if you can list the vehicle as stolen...."
Hang on but I'm the owner of the vehicle ? and I can't list it as stolen...
"you need to talk to a constable..."
I did this last night at the Napier police station... we'll see if they can be bothered
I'm going to head for a drive today to hastings see if I get lucky
Tonight I'm also going to post this up on every automotive website in New Zealand people need to see how useless the cops are and how bigger risk they take in trusting people

I'd second that.
Sounds like you were too much of a nice guy to start with Reece. Must be hard for ya to keep ya cool over it.
If you do get face to face with him, remember, you don't wanna lose your firearms license over it. Coz you'll never be able to get it again. It's not worth it.

Friends old man went through a similar drama (except his car was worth 40k) and after trying to go through the police channel and then finding out the location of the car himself he paid a well known gang to use a little persuasion, or a lot of persuasion if needed, to get his car back.

No punches were thrown and a transporter was dropping it off at his house 2 days later.

So what do you do? If the police wont do anything, and they tell you you're not allowed to take it into your own hands what is there left to do?
It really shits me that I can pass 4 or 5 speed cameras every week on my way to work, go through a couple of reg/wof checks at the weekend and when you report something stolen, suddenly it's in the too hard basket. My STi got stolen about a year ago and it did a few petrol drive offs, a number of speed camera fines and it was only when the neighbour of the household called in about it doing helis at the end of the street did they find my car...
Then you read about a top cop getting done for selling P in his spare time, you really start to wonder who it is they're protecting. I know each individual cop goes out there to make a difference, but as a team they're failing us miserably.

And if the police did anything its going to cost more in time and lawyers fees than its worth and all they will get is told off and asked to pay it back at $2.50 per week if it wouldnt leave em to poor.

the police won't want anything to do with it. Get your mates and go sort it out, get someone else to video it and don't let the anger get better of you. Stay calm and all the business.... just get it done....

Mr Hapeta Matthews or Matthew Loggan probably came back and 'claimed' his vehicle back. You made it easier for him parking it on the road.

Or talk to bonafide repossession agents, they will know some tricks without
getting vicious.
