Feedback wanted : East Coast CMT

Ngati Porou East Coast Customary Marine Title Enquiry -
Til Friday 12 July

The Minister of Marine & Coastal Area Claims, Mr Finlayson has decreed that there will be an enquiry into the Ngati Porou Marine & Coastal Area Claim for control of certain areas of the East Coast foreshore and seabed, as agreed with the 2008 Minister, Michael Cullen and the Clark Labour Government.

This review will run from Mon 23 May – 5 pm on Friday 12 July.

There will be a briefing by the Office of Treaty Settlements, for interested parties next Monday, 10th June from 12 noon to 7 pm at the Emerald Hotel in Gisborne.

The Minister stresses that it is a factual enquiry, so any evidence that the public may present needs to be of a factual nature, relevant to the requirements of the Marine & Coastal Area Act 2011. This Act is available at http://www.legislation.govt.nz/act/publ ... tml?src=qs

He has appointed former High Court Judge Dame Justice Judith Potter as an Independent Assessor, who will provide a “non-binding independent, expert view as to whether the Crown may be satisfied the applicant group meets the requirement of the Act, based on thye evidence provided to her”. So it is essential relevant evidence be presented to her.

Arguments against Ngati Porou gaining Customary Marine Title (CMT) are likely to hinge on whether they have controlled these remote areas, without settlement or fishing or recreational activity by other groups, since 1840. Eg are there properties owned by non-tribal people, or public roads to the coast etc.

If you have lived on the East Coast and know the areas being proposed for Ngati Porou CMT, then please contact me if you want to discuss anything relevant. I intend to attend the meeting in Gisborne next Monday afternoon. Anyone else considering doing likewise please feel free to contact me.
